13409. UNCONFIRMED minutes of an ordinary meeting of the Silverdale Parish Council (PC) held on Tuesday 6th June 2023 at 7pm at the Silverdale Village Institute, Spring Bank, Silverdale.

13411. Apologies for Absence – County Cllr Williamson due to her sustaining an injury following a meeting of the Preston Regeneration Board and was unable to drive.
13412. Co-Option for Councillor Vacancy – Cllr Bond proposed to accept the application from Ian Fisher, seconded by Cllr Reed. Ian accepted the position, signed the Declaration of Acceptance of Office and joined the meeting as a Parish Cllr.
13413. Declarations of Members’ Interests – Cllr Houghton declared a pecuniary interest regarding item 13426 b) iii being the owner of the land in question.
13414. Approval of the Minutes from the Previous Silverdale Parish Council Meeting – an amendment needs to be made to item 13405 f) as the total cost for the Cllr training course is £35 not £70 as only one Cllr needed to attend. Following this, the minutes of the annual PC meeting held at the Silverdale Village Institute on Tuesday 9th May 2023 were APPROVED by Cllrs and passed to the Chairman for signing.
13415. Matters arising from the Minutes of Previous Meetings, not Covered by the Agenda: a) 13376 Ash Trees Surgery provision in Silverdale – whilst an acknowledgement has now been received from the Practise Services Manger, the request for a meeting was ignored and no new information or assurances given. The PC to continue to push the matter with Ash Trees for a meeting so the concerns of the PC can be discussed in person.
b) 13399 d) Digging on PC land – would not be appropriate in a biological heritage site. Cllrs AGREED for permission not to be granted.
c) 13246 Lack of mobile phone coverage – contact MP David Morris for an update on the Shared Rural Network (SRN) agreement mentioned in his response last November and see if there is an update on when/whether this includes Silverdale. The £1billion deal was between mobile network operators and the Government to share the investment costs and should increase 4G mobile coverage throughout the UK to 95% by the end of 2025.
d) 13216 g) Trees at the Corner House development – follow up with Lancaster City Planning as to whether the matters raised in a letter sent back in December 2022 regarding concerns found in the arboricultural report have been dealt with.
e) 13338 e) Field Day – the committee has requested use of the PC radios to help coordinate operations on the day. Cllrs AGREED for their use by the Field Day Committee, Cllr Bennett to ensure they are fully charged and available on the day.
f) 13344 Hazardous crack in boundary wall of 28 Stankelt Rd – following PC correspondence to the surveyors of the property, a gauge has since been affixed across the crack to check for any movement. The PC AGREED they are acting responsibly to monitor the situation in a professional manner, and so should leave it in their capable hands unless a significant change is seen to occur.

13416. Report of Relevant Matters from Police Sergeant (PS) L. Brown – thanks given to PS Brown for his attendance at the meeting to give the following verbal report on matters affecting Silverdale since the 9th of May: a) 21 reported incidents – 1 theft (climber’s bag at Trowbarrow Quarry), 1 injury from road traffic collision (Emesgate Lane), 1 suspicious circumstance (noise of glass smashing, officers on scene within 20 mins), 1 sudden death, 6 information reports regarding criminal activity, 11 suspected burglaries (3 confirmed; a workshop at Woodwell plus dwellings on Lindeth Road and Hazelwood)
b) Concerns over recent spate of burglaries and attempted burglaries:
i. The investigation – 3 people residing in Silverdale were arrested and released on bail pending charges on the condition they were not to return to anywhere within the parish of Silverdale. However, since then the bail conditions have been breeched and the suspects have been detained pending a remand in custody decision. There is a significant amount of CCTV and potential forensic evidence connecting the suspects to the burglaries and Lancashire Constabulary are confident charges will be brought pending the forensic results. PS Brown emphasised that since the first burglary was reported, the Rural Task Force have been active in and around Silverdale, both uniformed and plain clothed and thanks residents for their swift actions, without which the arrests could not have happened so quickly. PCSO’s have also been in the village carrying our reassurance work to residents and are available if anyone needs further advice or is concerned.
ii. Concerns from residents of Lindeth Close in attendance – PS Brown assured residents that they are working with the Lancaster City Council Housing department regarding the tenancy agreement for the property in Silverdale the suspects have been connected to. City Cllr Greenwell has also been in contact with the Head of Housing at Lancaster City Council, J Wilkinson, who is looking into the initial application and whether there has been any fraudulent information given. At this stage in the investigation, photos cannot be circulated of the suspects, PS Brown reiterated that residents are not to put themselves in danger if they suspect the suspects have returned to the area and that any suspicious activity would be a 999 call.
c) No ‘cold calling zone’ – County Council are the lead agency with this, PS Brown has requested an update and will inform the PC once received.
d) CCTV at village entry/exit points – Cllr Bennett proposed the idea of a PC funded CCTV network covering the four entry/exit points of the village, initially estimated to be an additional £25/year for each of the 650 registered dwellings and whether PS Brown would be able to look into the viability if there is strong support from residents. Whilst PS Brown would be happy to assist, he wanted to reiterate again that this spike is out of the ordinary and that these particular suspects have been swiftly identified and detained. Silverdale remains to be one of the safest parts of Lancashire to live and that almost all of the properties affected were unoccupied.
13417. Report of Relevant Matters from Lancaster City Councillor Alan Greenwell – City Cllr Greenwell circulated a report to Cllrs ahead of the meeting detailing the following information:
a) Planning Committee – Cllr Greenwell is part of the Planning Committee at City Council which he hopes will be of use to PC over the coming years.
b) Rural England Prosperity fund – the first payment from central government has now been received of the £500,000 allocated over the next 2/3 years to fund capital projects for small businesses and community infrastructure to improve productivity and strengthen the rural economy and rural communities. City Cllr Greenwell met with Cllr Houghton and Cllr Unsworth to discuss the purchase and installation of a ‘green’ disabled-access toilet at The Shore with an application being prepared to be submitted by 11th July 2023.
c) Lindeth Close – City Cllr Greenwell has written to the Chief Officer at City Council, W. Griffith, to make him aware of a number of issues requiring action.
d) Bench outside Gaskell Hall – following requests from residents for a seat at the bus stop outside the Gaskell Hall, permission has now been granted by trustees for one to be installed. City Cllr Greenwell will now take the matter forward to City Council.
13418. Report of Relevant Matters from Lancashire County Councillor Phillippa Williamson – non available.
13419. Matters Raised by Members of the Public for Future Consideration – following the acceptance of I. Fisher as a Cllr, the remaining 18 members of the public raised the following concerns:
a) Planning application 23/00264/FUL – there has been no public notice displayed regarding this planning application for the land at Spring Bank when neighbouring residents and Cllrs were informed on 9th May.

Given there is only 21 days in which to submit a comment there ought to be an extension to allow other residents time to consider the application and its associated implications.
b) Eviction of residents on Lindeth Close suspected in recent burglaries – residents request PC support in request for tenants to be evicted following their suspected involvement in the recent burglaries together with the weeks of anti-social and intimidating behaviour they have caused since their arrival.
c) Local authority housing in Silverdale – request for there to be Local Occupancy Clause on social housing in Silverdale to ensure the limited stock that is available is given to those who have an established connection to the village.
d) Overnight campervans at The Shore – saddened to still see campervans staying on The Shore overnight, had counted up to 12 one night. Believes the view should be unrestricted for everybody’s enjoyment and does not want to see it becoming like a campsite.
e) Rats on Shore Green – City Council Pest Control were called in by a resident on Shore Green who was then informed there is a problem with rats throughout the village with a particular infestation by the public toilets and was this something the PC were aware of.
f) Dangerous parking – given the recent accident on Emesgate Lane where a pedestrian was injured, can more be done to prevent the dangerous parking, perhaps polite notices asking people not to park. g) Parking on Shore Road – residents are struggling to get in and out of their own driveways due to inconsiderate parking.
13420. Verbal Reports from any Meetings of Relevance Attended by Members, or the Clerk, Circulated Before the Meeting and Not Listed Elsewhere in the Agenda:
a) 19th May – Transport and Access WG – included representatives from the National Trust, Leighton Hall and RSPB were also in attendance. Minutes to be circulated to Cllrs for information.
b) Net-Zero Carbon WG – minutes currently being finalised then will be circulated to Cllrs for consideration.
13421. Planning Matters:
a) The following planning applications were dealt with under the provisions of Standing Order 25: i. 23/00498/VCN – 28 Stankelt Road (emailed 04/05) – demolition of existing rear rotunda and porch and erection of replacement porch, conversion of existing garage to ancillary living accommodation with erection of a single storey side extension and glazed link extension, erection of a single storey extension to front and side to include replacement garage with associated landscaping (pursuant to the variation of condition 2 on planning permission. No further comment but would emphasise again the concerns about the adequacy of the existing sewage system.
ii. 22/01372/FUL – Wood Close, Stankelt Road (emailed 05/05) – amend plans to alter the layout of the potting shed and green house and extend the single storey side extension. No further comments. iii. 23/00264/FUL – land at Grid Ref E346290 N475228, Spring Bank (emailed 09/05) – erection of a single storey dwelling (C3) with associated package treatment plant, access and landscaping. Oppose due to a number of factors that appear to be contrary to the AONB DPD.
b) The following planning applications were considered – none.
c) Requirements and regulation of campsites in the AONB, with particular reference to Silver Sapling – permitted development rights allow a temporary change of use for tented camping only for up to 28 days of the year without the need of formal planning permission. The land in question must not be part of any land associated with an existing building, including house gardens, car parks, agricultural buildings and listed buildings. If there is evidence to suggest the contrary, City Council Planning would need to be informed to take the matter forward. In addition, the AONB DPD states that no new camp/caravan sites would be allowed.
d) Clarification on existing, established camping/caravan sites within the Silverdale area – Gibraltar Farm, Hollins Farm, Bottoms Farm, Holgates Caravan Park, Hawes Villa and Scout Cragg

c) Audit matters – the Internal Auditors report for the year ending 31st March 2023 was received on the 9th May and confirmed that the PC is compliant with all account and audit regulations and statutory requirements. d) Accounts for the year end 31st March 2023 – it was noted that the 31st March 2023 accounts will now be sent to the External Accountant and that the period for Public Inspection will take place from the 5th June until the 14th July 2023.

i) Confirmation that the Gesualdo Six are booked for the 14th October at St John’s church, tickets will be available online (emailed 26/05)
j) A resident writes about the new ice cream shop opening next to the Post Office being an added threat to its continuance (emailed – 29/05) – not an reason that the PC can raise concerns over however Cllr Fishwick does believe the large queues which form on the narrow footpath could pose a threat to public safety.
13425. Playground Matters – Cllr Bennett circulated a report to Cllrs ahead of the meeting which detailed the following:
a) Urgent actions taken –none
b) New issues noted on the Parish Contractor’s weekly inspection reports – none
c) Ongoing issues –
i. Quarterly inspections by Lancaster City Council (CC) – following Cllr Bennett’s email to Public Realm an inspection on the 24th May has since been carried out and a 70-page report issued. Cllr Bennett has produced a summary of the report which details only Low/Very Low Risk actions and circulated to Cllrs for consideration. A plan of action to address the issues raised has been discussed with the Parish Contractor and target dates set for their completion. A request has been sent to Lancaster CC to provide a quote for repairing the wet pour soft surfaces and contractors are being sought to provide quotes for repointing the paving inside the entrance area.
ii. Repairs to the cone climber – thanks to the generous assistance of Mr Ormerod (of Cove Road) the bearing has been reworked then refitted by the Parish Contractor and the apparatus is now back up and running. Cllr Bennett expressed his sincerest thanks to Mr Ormerod who provided his assistance free of charge.

Whilst working on the lower bearing unit, some wear was found on the M6 bolts attaching the cone nets. These have all been replaced with new bolts of a certified, traceable quality. Together with cleaning and re-lubricating the other bearing at the top of the unit, these recent works have now effectively “overhauled” the unit, making it fit for a further 10 years or more of service.
iii. Formal ROSPA playground risk assessment – no price as yet for this to be carried out. Cllr Bennett to chase and circulate to Cllrs for consideration once received.
iv. A minor operating a leaf blower – Cllr Fishwick observed a young person of estimated age 8/9years, apparently connected with the contracted company, or with the approval or agreement of the company, operating a grass/leaf blower machine in the children’s playground during the day whilst other children were present. Although not a machine with exposed cutting blades, it may have been petrol powered and from a Health and Safety perspective would require the operator to be of suitable age to handle and to understand the correct methods of operation and its associated. The Clerk has written to the contractor for clarification and awaits a response.
v. Tree damage due to contracted strimming – once again damage has been reported following the strimming of the playground. Whilst reminders can be sent to the contractor it is inevitable this will continue to happen. Cllrs AGREED for Cllr Bond to look into and circulate the costs of fitting guards to the young/vulnerable trees within the playground.
13426. Working Groups (WG) and Streetscape Matters:
a) Formal process for assigning Cllrs to WGs – Cllr Bennett and Cllr Bond to formalise the process to enable a fair representation of Cllrs on WG’s and circulate to Cllrs for consideration and approval. b) Road safety/highways:
i. InPost locker outside the railway station – E. Mills from County Highways has confirmed the structure is on their land and not that of Northern Rails. Attempts to contact InPost has only produced an automated response, the PC to continue to try and speak to a real person. As the locker is powered through mains electricity from the station, Northern Rail ought to have agreed to its installation so the PC will continue to push for a response. Cllr Reed to clarify with E. Mills whether County Highways are also pursuing the matter.
ii. Collapsed stone wall at Post Office Lots – whilst the land is owned by the National Trust, the responsibility to repair the wall is down to the tenant farmer. The National Trust are very aware of the wall and assure the PC its repair has been discussed and will be done in due course.
iii. Overnight Parking at The Shore – evidence of overnight stopovers needs to be collated to take the matter further with City Planning as Permitted Development Rights on temporary change of use may not apply to carparks and campervans.
iv. Parking on the footpath on Gaskell Close – Cllr Unsworth to publicise the dangers of parking on a footpath in the next issue of the Parish magazine.
c) Toilets – given the significant rise in cleaning costs and maintenance due to the continued vandalism the PC feel it is no longer a viable option to keep them open not only from a cost point of view but also on how their poor condition reflects upon the village. Cllrs AGREED this is not a decision that can be taken without giving residents the opportunity to comment and so will publish information regarding the PC’s justification for closure and discuss at the next meeting.
d) Clearance of Bankwell – the public responses received on potential works suggest residents would like the site to remain as natural and undeveloped as possible. Cllrs AGREED to continue with the annual clearance cuts and to look into costs of a small perimeter fence for to stop visitors inadvertently walking into the water.
e) Defibrillators – the installation of the new box outside the Gaskell Hall has been delayed due to the trustees of the Gaskell Hall seeking additional quotes for the works to be carried out. Cllr Reed to confirm with the trustees that the PC has previously agreed to cover the costs of the installation and can instruct Clarksons Electrical Solutions of Carnforth to carry out the works next month.

15 Playground
• To receive a report on any urgent actions that have been taken and to consider any other issues raised in either the Lancaster CC quarterly, or Parish weekly inspections.
• To consider the points raised in a Lancaster City Council playground inspection report issued on 24th May 2023, (a summary of the Lancaster City Council 70 page report is being prepared for Councillors).
• To consider approving a quotation from RoSPA to create a formal Risk Assessment for the Playground with the intention, subject to approval from Council, of adopting it into our Health and Safety management plan.
16 Working Parties/ Streetscape.
a) Working groups
• To decide upon the processes for assigning Cllrs. to working groups.
b) Road Safety/Highways.
• To review the situation regarding the position of the Inpost Box at the Station.
• To consider what to do about disgraceful state of the National Trust collapsed wall and dangerous strand of barbed wire on Stankelt Road just before the steps to The Lots.
c) Parking.
• To consider the visits from Campervans on the foreshore following the complaints received and to decide whether there should be any action taken.
• To consider the issues relating to parking in Gaskell Close on the footpath.
d) Toilets.
• To review the service of the new cleaners and the current level of vandalism and decide what action to take.
e) Wells/Quarries.
• To decided what action to take regarding Bankwell’s clearance.
f) Health Matters
• To consider alternative locations for the Defibrillator besides the Methodist Church.
